Annotation:		The paper deals with determining the legal nature of the right to use dwelling family members of the cooperative based on the definition of signs that allow to distinguish between proprietary and contractual right. The author concludes that the right to use the dwelling family members of the cooperative was in rem, since it has features, quality inherent in any in rem right - the materiality of the object and absoluteness
